Terms of Service

PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF "YOU", "THE USER" "MEMBER" "REPRESENTATIVE", "PARTICIPANT", "ASSIGNED DRIVER", "SUBSTITUTE DRIVER", "ASSIGNED PASSENGER", "DRIVER", "PASSENGER", "CLIENT", OR "PROSPECTIVE CLIENT" TO READ THE TERMS OF SERVICE BEFORE PROCEEDING TO ACCESS, USE, AND/OR INSTALLING THE COMPANY'S PLATFORM. IF YOU DO NOT EXPRESSLY AGREE TO ALL OF THE TERMS OF SERVICE, THEN PLEASE DO NOT ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS EFFECTIVE AS OF 10/17/2018.

1. ACCEPTANCE OF TERMS

The following Terms of Service Agreement (the "TOS") is a legally binding agreement that shall govern the relationship with our users and others which may interact or interface with Quruz, LLC, also known as Quruz "the company", including the sites, or platform, and our subsidiaries and affiliates, in association with the use of quruztransportation.com, and any existing source authorized by Quruz services which shall be defined below.

2. DESCRIPTION OF WEBSITE SERVICES

The Site is an e-commerce booking website which has the following description:

 

Definitions:

​

Assigned Driver - The motorist/official representative of Quruz with the occupation of a designated driver. Transports each Assigned Passenger to their requested destination(s) preferred by Assigned Passenger’s scheduled requested Trip Service Plan, or Shuttle Service Plan.

 

Assigned Passenger - The client requesting a ride from Assigned Driver for transportation from a starting location to scheduled requested destination(s).

​

Service Vehicle - The mobile transportation source Assigned Drivers will use to complete client's plan.

 

Trip Service - A plan with the seat capacity of one Assigned Driver and one Assigned Passenger in the service vehicle.

​

Shuttle Service - A plan with the seat capacity of one Assigned Driver and multiple Assigned Passengers in the service vehicle.

​​

Trip Service/Shuttle Service Pass Form - The document clients/Assigned Passengers must complete before any requested Assigned Driver is designated to complete any Trip Service/Shuttle Service requested.

​

Trip Service/Shuttle Service Plan - Assigned Passenger's specified request on the Trip Service/Shuttle Service Pass Form for transportation from one location to another. (Round Trips are optional.) 

​

Trip Service/Shuttle Service Pass - Gives passengers access to receive transportation based on a set destination, distance radius, price, and scheduled time an Assigned Passenger request from the available Assigned Driver before any transportation process is complete. (Round Trips are optional.) 

​ 

Set Transportation Rate - The exact price for each service pass. (Additional charges may apply.)

 

Starting Location - The current first point on GPS where a client has scheduled transportation from a point on GPS to a requested destination on GPS.

​

Requested Destination - The location on GPS a client schedules to be transported to.

 

Current Transportation Rate - The fare price if a fee is added to the set transportation rate during traveling to locations within a client's service plan.

 

Pick-up Time - The scheduled time a client request for Assigned Driver to begin services for their plan.

 

Early Pick-up Listings - Displays the predicted amount of extra minutes the available driver would need to ensure every passenger arrive at their requested destination(s) at an appropriate time.

 

Round Trip - Assigned Passenger has the option to schedule Assigned Driver to drop them off at a requested destination, then come back to Assigned Passenger’s current requested destination a later time to transport Assigned Passenger back to the starting location.

 

Current Requested Location - The point on GPS where Assigned Driver has dropped off Assigned Passenger or their merchandise based on their request.

 

Current Transportation Location - The point on GPS where Assigned Driver with Assigned Passenger or their merchandise in their service vehicle is currently located.

 

Distance Radius - The range Assigned Driver has to travel to complete a client's request; from a client's starting location to any of their requested destinations.

First Requested Destination - The point on GPS where a client schedules service for Assigned Driver to travel; from a client's starting location to a requested destination.

 

Next Requested Destination - The point on GPS where a client schedules service from one requested destination to a different destination.

 

Last Requested Destination - The point on GPS where Assigned Driver is scheduled to travel to complete the service.

 

Additional Requested Destination - A requested transportation to another destination other than what a client's requested service plan entails.

 

Substitute Driver - An Assigned Driver that replaces a different Assigned Driver. Example: If Assigned Passenger wants a different driver to transport them to their remaining scheduled requested destination(s) the Substitute Driver replaces Assigned Driver and proceeds transportation for Assigned Passenger’s Trip Service/Shuttle Service Plan. If Assigned Driver is unable to complete Assigned Passenger’s Trip Service/Shuttle Service Plan for any reason, the Assigned Driver or Quruz arranges a Substitute Driver to pick up Assigned Passenger at their current requested location, then proceed transportation to Assigned Passenger’s next requested destination(s) until the trip is complete.

Pass Terms - The duration each pass is valid for.

​

Contract Term - Contract Terms are used to generate a total profit based on the amount of days drivers are willing to transport passengers.

​

Free Service Pass - A reward to waiver the set transportation rate on a client's next scheduled service. (Round Trip included.)

​

Daily Service Pass - A client pays a set transportation rate to preferably use a Daily Service Pass, which arranges an Assigned Driver to complete their requested plan; starting either on the current day, or any time within 365 days after the purchase date. (Additional charges apply for Round Trips.)

 

Three Services Pass - A client pays a set transportation rate to preferably use 1 of 3 Three Services Pass, which arranges an Assigned Driver to complete their requested plan; starting either on the current day, or any time within 365 days after the purchase date. (Additional charges apply for Round Trips.)

 

Five Services Pass - A client pays a set transportation rate to preferably use 1 of 5 Five Services Pass, which arranges an Assigned Driver to complete their requested plan; starting either on the current day, or any time within 365 days after the purchase date. (Additional charges apply for Round Trips.)

 

Seven Services Pass - A client pays a set transportation rate to preferably use 1 of 7 Seven Services Pass, which arranges an Assigned Driver to complete their requested plan; starting either on the current day, or any time within 365 days after the purchase date. (Additional charges apply for Round Trips.)

 

Weekly Service Pass - A client pays a set transportation rate to preferably use 1 of 7 Weekly Service Pass, which gives a client access to receive seven - fourteen services within 7 consecutive days; starting either on the current day, or any time after the first service. (Additional charges apply for Round Trips.)

 

Biweekly Service Pass - A client pays a set transportation rate to preferably use 1 of 14 Biweekly Service Pass, which gives a client access to receive fourteen - twenty-eight services within 14 consecutive days; starting either on the current day, or any time after the first service. (Additional charges apply for Round Trips.)

 

Monthly Service Pass - A client pays a set transportation rate to preferably use 1 of 31 Monthly Service Pass, which gives a client access to receive thirty-one - sixty-two services within 31 consecutive days; starting either on the current day, or any time after the first service. (Additional charges apply for Round Trips.)

3. Set Transportation Rate Policy

The set transportation rate for any Service Pass will always remain the same unless these circumstances occur:

 

$4.50 - $6.50 set transportation rate for a Shuttle Service traveling within five miles from Assigned Passenger's starting location to their requested destination. Service vehicles with a capacity of:​

  • Four+ passengers has a base rate of $4.50.

  • Three passengers has a base rate of $5.50. 

  • Two passengers has a base rate $6.50.

$1.00 per mile accumulation begins when Assigned Driver exceeds the five-mile distance radius when transporting Assigned Passenger from their starting location, to their scheduled requested destination(s). ($1.00 per mile accumulation stops once Assigned Driver or Assigned Passenger has ended the transportation.)

$3.00 - $5.00 base rate applied to a Shuttle Service request with an additional destination for traveling within five miles from Assigned Passenger's current requested destination to their next requested destination. ($1.00 per mile accumulation begins when Assigned Driver exceeds the five-mile distance radius when transporting Assigned Passenger from their current requested destination to their next requested destination.)

$7.50 set transportation rate for a Trip Service traveling within five miles from Assigned Passenger's starting location to their requested destination. $1.00 per mile accumulation begins when Assigned Driver exceeds the five-mile distance radius when transporting Assigned Passenger from their starting location, to their scheduled requested destination(s). ($1.00 per mile accumulation stops once Assigned Driver or Assigned Passenger has ended the transportation.)

$7.00 base rate applied to a Trip Service request with an additional destination for traveling within five miles from Assigned Passenger's current requested destination to their next requested destination. ($1.00 per mile accumulation begins when Assigned Driver exceeds the five-mile distance radius when transporting Assigned Passenger from their current requested destination to their next requested destination.)

​

.30% of the travel duration rate for Round Trip if Assigned Driver does not return from Assigned Passenger's current requested destination to their starting location. (Example: Assigned Passenger is at their current requested destination, they request a Round Trip back to their starting location, the travel duration of the two locations are ten miles, and  fifteen minutes apart, the normal Trip Service transportation rate for ten miles would be approximately $12.50 ($7.50 for the first five miles + $1.00 per mile = $12.50), then add ten minutes to the first free five minutes to give a total of $15.50). 

​

84% of the set transportation rate for Round Trip of returned Assigned Driver request from Assigned Passenger's current requested destination to their starting location. (Example: Assigned Passenger is at their current requested destination, they request a Round Trip back to their starting location, the distance radius of the two locations are ten miles apart, the normal Trip Service transportation rate would be approximately $12.50 ($7.50 for the first five miles + $1.00 per mile = $12.50), then 84% of $12.50 calculates $10.50 added to the current transportation rate for a total of $23.00). 

​

.20 cents per minute added to the set transportation rate if Assigned Passenger wants Assigned Driver to wait more than 5 minutes after arrival at Assigned Passenger’s current requested location, then take Assigned Passenger to a requested destination. Example: Assigned Passenger informs Assigned Driver about the estimated time they plan to be occupied at the current requested location for “25 minutes”, .20 cents x 20 minutes = $4.00 charged, and added to the set transportation rate before Assigned Passenger exits Assigned Driver’s vehicle. If Assigned Passenger hasn’t returned into Assigned Driver’s vehicle after 25 minutes, Assigned Driver will call Assigned Passenger to ask if they want them to continue charging the card for an estimated time, or leave after 5 more minutes of waiting resulting in Assigned Passenger to request a different driver. (.20 cents per minute accumulation starts once notified upon arrival at Assigned Passenger’s current requested location; accumulation stops when Assigned Passenger has finished their occupancy at the current requested location then returned into Assigned Driver’s vehicle.) .20 cents per minute also applies to drive-thru destinations.

 

.40 cents per minute added to the set transportation rate after Assigned Driver travels over five minutes from Assigned Passenger's starting location to the requested destination.

​

.80 cents per minute added to the set transportation rate if Assigned Driver agrees to transport Assigned Passenger to an unexpected additional requested destination. (.80 cents per minute accumulation starts the moment Assigned Driver is notified of Assigned Passenger’s unexpected additional requested destination, until Assigned Passenger has finished their occupancy at the current unexpected additional requested location and returned into Assigned Driver’s vehicle.)

​

Assigned Passenger will choose the Turnpike Service Pass option on the booking page to pay for toll trips throughout your transportation. An invoice may be sent before service to pay for the toll in advance. Drivers may cancel the request if their passenger chooses a different type of pass.

​

Shuttle Service Pass rates can remain the same even when the amount of Assigned Passengers are lower than the expected vehicle capacity if Assigned Driver agrees. (Example: Assigned Passenger request a pass with the total capacity of three passengers in the vehicle, the Assigned Driver can keep the rate at $4.00 even if they currently have one passenger in their vehicle.) 

​

Round Trips and Additional Requested Destinations are valid for 24 hours after the drop-off time.

 

A surcharge may be applied if drivers have to pay for parking, or any fee necessary to successfully complete their Assigned Passenger's service request.

​

The transportation rate for your Service Pass may change two weeks after expiration.

​​

​

4. Service Description

​

Each Trip Service/Shuttle Service Pass offered has a set transportation rate depending on Assigned Passenger’s request. 

 

This is how Assigned Passengers can request a Trip Service/Shuttle Service Pass: 

 

  1. Assigned Passenger must complete a Trip Service/Shuttle Service Form to request an Assigned Driver.
  2. When the Trip Service/Shuttle Service Pass Form is complete and approved by Quruz, an Assigned Driver will be presented (based on Assigned Driver’s preferred route and availability) to Assigned Passenger’s starting location. Additional charges apply for each Round Trip.  (Passengers may receive a request for an earlier pickup time based on the Early Pick-up Listings for a Shuttle Service only.). 
  3. The Assigned Driver is aware of the scheduled time, location, and set transportation rate Assigned Passenger prefers, abiding by the specified request of each Trip Service/Shuttle Service Pass.

 

One requested destination (a set rate of $3.00 - $6.00 or 84% of the one-way rate added for each Round Trip):

​

  1. Assigned Driver’s occupation is to transport each Assigned Passenger from their starting location to a scheduled requested destination after accepting Assigned Passenger’s Trip Service/Shuttle Service Pass. ($1.00 per mile added to the set transportation rate during transportation when Assigned Driver exceeds the distance radius of Assigned Passenger’s starting location, to their scheduled requested destination(s). ($1.00 accumulation stops once Assigned Driver or Assigned Passenger has ended the transportation.)

  2. Assigned Passenger has the option to tell Assigned Driver to:

    • Drop them off at the requested destination to complete the service.

    • Wait less than five minutes at the requested destination location for a Round Trip. 

    • Come back a later time (or Substitute Assigned Driver would come back) to pick up Assigned Passenger at the requested destination for a Round Trip.

  3. When Assigned Passenger finishes their occupancy at current requested destination location and has returned into Assigned Driver's/Substitute Driver’s vehicle, the present Assigned Driver/Substitute Driver would then transport Assigned Passenger back to their starting location to complete the Round Trip. 

 

Two requested destinations (a set rate of $3.00 - $6.00 or 84% of the one-way rate added for each Round Trip):

 

  1. Assigned Driver’s occupation is to transport each Assigned Passenger from their starting location to two scheduled requested destinations after accepting each Assigned Passenger’s Trip Service/Shuttle Service Pass. ($1.00 per mile added to the set transportation rate during transportation when Assigned Driver exceeds the distance radius of Assigned Passenger’s starting location, to their scheduled requested destination(s). ($1.00 accumulation stops once Assigned Driver or Assigned Passenger has ended the transportation.)

  2. Assigned Passenger has the option to tell Assigned Driver to: 

    • Wait less than five minutes at the first requested destination, then continue service when Assigned Passenger has returned into Assigned Driver’s vehicle.

    • Drop them off at the first requested destination, then come back a later time (or Substitute Driver would come back) to pick up Assigned Passenger at the first requested destination location then continue the service.

  3. When Assigned Passenger finishes their occupancy at the first requested destination location, and has returned into Assigned Driver’s/Substitute Driver’s vehicle, the present Assigned Driver/Substitute Driver would then transport Assigned Passenger either: 

    • To the second requested destination to continue the service.

    • Back to starting location for a Round Trip.

      • When Assigned Passenger finishes their occupancy at starting location and has returned into Assigned Driver’s/Substitute Driver’s vehicle, the present Assigned Driver/Substitute Driver then transports Assigned Passenger to the second requested destination.

  4. Assigned Passenger has the option to tell Assigned Driver/Substitute Driver to: 

    • Drop them off at the second requested destination to complete the service.

    • Wait less than five minutes at the second requested destination for a Round Trip or proceed to additional requested destination(s) scheduled.

    • Drop them off at the second requested destination, then come back a later time (or Substitute Driver would come back) to pick up Assigned Passenger at the second requested destination location for a Round Trip or proceed to additional requested destination(s) scheduled.

  5. When Assigned Passenger finishes their occupancy at the second requested destination location and has returned into Assigned Driver’s/Substitute Driver’s vehicle, the present Assigned Driver/Substitute Driver would then transport Assigned Passenger:

    • Back to their starting location to complete the Round Trip.

    • To additional requested destination(s) scheduled until the service is complete. 

(A set rate of $3.00 or $6.00 added to the transportation rate for an additional destination if Assigned Passenger request a ride to more than two destinations per plan. The same concept Assigned Drivers perform to complete two requested destinations plan applies to any additional destination scheduled.)

5. Cancellation Policy

We wish to produce the safest, satisfying, and convenient service possible. We practice this policy so participants can refer to our company with confidence, respect, and trust that their requirements will be met.

​

Passengers have the right to cancel or modify their trip for no charge if done so more than two hours before the first scheduled pick-up time of their plan. The refund will be dispersed within 7 - 10 business days. (Passengers can change their Assigned Driver to a Substitute Driver for no additional charge if done so two hours before their scheduled pick-up time.)

​

If a passenger waits less than two hours to cancel a trip before the first scheduled pick-up time of their plan:

  • 90% of the transportation rate will be refunded within 7 - 10 business days for a Daily Service Pass.

  • 50% of the transportation rate will be refunded within 7 - 10 business days for a Three Service Pass, Five Service Pass, and Seven Service Pass.

  • 33% of the transportation rate will be refunded within 7 - 10 business days for a Weekly Service Pass, Biweekly Service Pass, and Monthly Service Pass.

 

Assigned Driver will be informed ahead of time of each plan. If Assigned Driver causes a passenger to be more than 10 minutes late from their expected drop-off time or arrives 10 minutes after the scheduled pick-up time:

  • 30% of the transportation rate will be refunded within 7 - 10 business days for a late service request (the only exceptions are bad weather conditions, heavy traffic witnessed by the passenger, if the driver has arrived at their Assigned Passenger's location but cannot find them, or any involuntary circumstance).

  • 100% of the transportation rate will be refunded within 7 - 10 business days for a canceled service.

  • 100% of the transportation rate will be refunded within 7 - 10 business days if Assigned Driver’s service vehicle is prevented from operating in the middle of service.

If Assigned Driver unexpectedly waits over five - ten minutes to continue service at a client's starting location or requested destination, Assigned Driver has the right to cancel the transportation process which will require a separate charge if a passenger wants transportation to the remaining requested destination(s).

 

Quruz suggests that clients should manually type their precise information and never use any location detector to automatically fill in their location. Clients possibly would not receive a refund if their information provided is misleading and not corrected two hours before their scheduled pick-up time, and a Substitute Driver will not be guaranteedIt is the client’s responsibility to validate their request so Quruz can provide accurate service. 

​

Quruz may not always be available to accept a client's service request. In an event Quruz or an Assigned Driver is unavailable to accept client's request, clients have the option to contact a different transportation service to complete the request.

 

Quruz ensures that every client understands their right to request a refund whenever they feel it is necessary, and to contact Quruz@yahoo.com to state the nature of the concern. The available representative will reach out immediately.

6. QURUZ SERVICE GUIDELINES

Please take a moment to read the general guidelines that are designed to ensure everyone receive a friendly, satisfying, convenient, five-star experience when associating with Quruz. Keep in mind if you are in a group you are responsible for each other’s behavior while completing service requests. A good spirit is contagious, as is a bad one. Be kind and courteous to your fellow citizens/members. Please exercise good character and behave pleasantly towards each other while associating yourself with Quruz participants, just as you would in any other professional environment. 

​

Below are suggested guidelines for providing a great experience interacting with others. Also noted are reasons why clients or representatives might be suspended from, or lose the opportunity to participate in Quruz services altogether. If we are notified of negative incidents, and misbehavior we will contact you to investigate the matter. Depending on the nature of the concern, we may put a hold on your services while investigating. If the situation is serious, repetitive in nature, or you refuse to cooperate, you will lose all access to participate in Quruz services.

Regulations of the Road:

​

During Services

​

  • You must abide by the laws of the state of Ohio.

​

  • Quruz is an intrastate transportation company offering services to Ohio participants only.

​

  • Alcohol and/or drug use is not permitted. As per the laws of the state of Ohio, you are not allowed to be under the influence of alcohol or drugs while operating any motor vehicle. If drivers ever consume enough alcohol to produce a blood alcohol concentration level of .08% or more Quruz prohibits drivers to operate as a Quruz driver for 24 hours. Please read: Ohio Liquor Control Law.

  • Always be sure to wear the safety belt upon entering the vehicle.

​

  • Never travel in large groups that exceed the number of seat belts available in the vehicle.

​

  • Children must always be supervised by a parent or legal guardian if the passenger is 17 years of age or younger traveling with adults. Minor Services Consent Form allows parents to book services for their minor to travel with peers.

​

  • The driver has control over the choice of music being played, or they can give the choice of music to any passenger currently in the vehicle. Respect the driver's and other passenger's choice of music. Do not ask the driver to play any offensive, or negative songs or audio. If you feel the choice of music is offensive, or violating, please inform us so we will try to match you with a driver that has control over playing the type of music you prefer.

  • Whether you are a driver or a passenger, please be polite to each other. Please no yelling, swearing, or slamming doors when exiting the vehicle.

​​

  • Please avoid conversational activity that may lead to uncomfortable situations such as: personal questions, verbal threats, off-color comments, social opinions, political opinions, racial comments, judgmental comments, sexual comments, and disrespectful gestures. Small talk among one another is normal. Keep the conversation pleasant for all. 

​​

  • Do not engage in negative behavior in the form of harassment, violence, sexual misconduct, discrimination, vandalism, drug use, or any other illegal activity.

​​

  • No firearms, or other harmful weapons are allowed near the vehicle.​​

​

  • Clean up any type of mess; spills, or trash to ensure that all passengers have a cleanly and satisfying ride. Keep the vehicle neat and clear of debris.

​​

  • Quruz nor the driver is liable for any losses, or damages of items Assigned Passengers bring into the vehicle.

​​

  • No unwanted contact shall be had with anyone while in the vehicle, or after the trip is over. Examples: calling, texting, or visiting someone after a ride has been completed. You do not want to overstep and damage the participant relationship.

DRIVER ETIQUETTE​​

​​

  • For the safety of your passengers, and yourself, always practice good defensive driving habits.​​

​​

  • Never try to rush through caution (yellow) traffic lights before it turns red. If you are approaching a yellow traffic light at 40 yards or more come to a safe stop while approaching before the yellow traffic light turns red, then wait for the green light to signal you to proceed.​​​​

​​

  • No texting while driving, ever. If you need to send or read a text pull over in a safe area free of moving traffic to do so.

​​

  • For making calls, you are advised to have a phone mount in your vehicle to utilize the hands-free speaker phone, headset, or Bluetooth. Please be aware that many communities “do not allow cell phone use at all while driving a motor vehicle.” As with scrolling through devices, please pull off the road and discontinue driving before attending to the devices. Please read: Governors Highway Safety Association​​.

​​

  • Please maintain your vehicle properly to avoid safety and mechanical issues. Remember to do the following, often: Oil changes, tire checks/rotation, belt inspections, hose inspections, suspension inspections, windshield blades, fluid level inspections (oil, transmission, brake, power steering, and different fluids) etc. A cared for vehicle is a safe ride.

​

  • Inform your insurance agency of your occupation, and liability coverage under Quruz.​

​​

  • Providing illegal unauthorized street hails or soliciting payment of fares outside Quruz services will harm the intellectual property of the business, our good name, and our trademark. Such activity will result in cancellation of your services with Quruz.

​

  • Quruz participants cannot interfere or disrupt the service of other Quruz participants.

​​

  • Quruz participants cannot transfer or sell Quruz account information, password and/or identification to any other person(s) or entity.

​​

  • Drivers cannot provide fraud services, operate as a public, regular, or common character other than a Quruz representative. 

​​

  • A driver will not charge a client a different transportation rate other than what Quruz requires. In addition, drivers may not bribe any client to pay in any form other than what Quruz has already arranged.​​

​​

  • Maintain complete up-to-date account information. Inaccurate or fraudulent information will not be tolerated and is grounds for suspension or loss of representation for the company. Good data relates to good business.

​

PASSENGER ETIQUETTE: â€‹â€‹â€‹

​

All Services

​

  • No pets in the driver's vehicle, people may be allergic to them.

​

  • No smoking in the driver's vehicle for the consideration of nonsmokers, and people with a respiratory challenge.

​

  • No eating or drinking in the driver's vehicle (except for water).

​

  • Inform Quruz of any sort of disability or injury, we are not authorized to provide disability/medical transportation.

​​

  • Do not keep the driver waiting no longer than five - ten minutes unless the driver agrees. Drivers are independent contractors operating on their own time, they legally are not obligated to wait five - ten minutes. Do your best to be on time for the service request. Please keep in mind that delays also may result in poor passenger ratings and negatively affect your reputation with other participants.

  • Drivers have the right to deny clients that are exposing their bare/nude bodily features. Drivers also have the right to deny passengers if the materials on their clothing or items are spreadable, dampened, wet, and/or dirty.

  • Only passengers that are scheduled for Assigned Driver at the moment may enter the vehicle.​​​

​

  • Do not disrupt, distract, or interfere with the driver's concentration of the road and the surrounding objects.

​

  • Clean up any type of mess, spills, or trash. Do not abandon your items to keep the vehicle in good condition and ensure that all passengers have a cleanly and satisfying ride. Keep the vehicle neat and clear of debris.​​

​​

  • If Assigned Passenger vomits in or vandalize Assigned Driver's vehicle or property belonging to Assigned Driver, they will be fined up to $2,500 and possibly face legal charges. Please read: Ohio Vandalism Law.

  • If we are informed of too many reports about operating services in dangerous or risky communities, we will discontinue our services in that particular area.

 

Weather

​

The climate can make things complicating for anyone trying to encounter it. Sometimes the climate will cause unexpected delays, interrupted operation, or sudden restriction of access to important sources. We will do whatever it takes to complete your plan as directed, please be advised that Quruz may decide to refund every scheduled service if climate gets too extreme for the safety of everyone.

The components attached to the base of each driver's service vehicle should be more than double of the precipitation level high above the surface it is operating over, enabling it to drive fluently during those weather conditions. Example: (if rain, snow, ice, sleet/hail is seven inches tall on the pavement driver's service vehicle has to operate on, the components attached to the bottom of service vehicles must be hovering fourteen inches or more high above that pavement because that's half of the amount of friction vehicles will be transporting through).

Four-wheeled drive should be active on pavements where tires will have to use a lot of traction to successfully travel through it. Example: (climbing steep hills, driving over mud, ice or puddles of water and hazardous areas).

​

Only vehicles with components equipped to endure severe climates will be eligible to operate during different weather advisories. If you are stuck in a climate issue during service, please contact rescue@quruzservices.com we will send recovery.

Contact support@quruzservices.com to give thorough feedback regarding any situation positive or negative that occurs during the transportation. This includes, accidents, arguments, bad driving, and great driving. We welcome this information, so we can understand which areas we are excelling, or’ need improvement. This will allow us to create a convenient, respectful, and safe experience for both our passengers and our drivers. Feedback and referrals from our fellow drivers, and especially our passengers will be the best asset to use for a better adventure.

7. Services

Any and all visitors to our site, despite whether they are registered or not, shall be deemed as "users" of the herein contained Services provided for the purpose of this TOS. Once an individual register for our Services, through the process of creating an account, the user shall then be considered a "member." 

 

The user and/or member acknowledges and agrees that Quruz is a source drivers and passengers can use for transportation services. Each driver or passenger has the right to accept, deny, or ignore services/trips from other user's of Quruz services. Every accepted service is considered an agreement between drivers and passengers. The Services provided and made available through our website and applications, which may include some mobile applications and that those applications may be made available on various social media networking sites and numerous other platforms and downloadable programs, are the sole property of Quruz. At its discretion, Quruz may offer additional website Services and/or products, or update, modify or revise any current content and Services, and this Agreement shall apply to any and all additional Services and/or products of Quruz and any or all updated, modified or revised Services unless otherwise stipulated. Quruz does hereby reserve the right to cancel and cease offering any of the aforementioned Services and/or products. You, as the end user and/or member, acknowledge, accept and agree that Quruz shall not be held liable for any such necessary updates, modifications, revisions, suspensions or discontinuance of any of our Services and/or products. Your continued use of the Services provided, after such posting of any updates, changes, and/or modifications shall constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all terms and policies currently in effect. Should you not agree to the updated, revised or modified terms, you must stop using the provided Services forthwith.

 

Furthermore, the user and/or member understands, acknowledges and agrees that the Services offered are for intrastate only provided on behalf of independent contractors and shall be provided "AS IS" and as such any agent, or company director of Quruz shall not assume any responsibility or obligation for any involuntary timeliness, unavailability, missed delivery, fares outside of Quruz platform, lost or interrupted connection to your device's internet server; or the Quruz App, personal afflictions through-out service request, damage to user's property, safety, infringements, impostors, hackers, the disclosure of your information through outside platforms on the internet, deletion and/or any failure to store user content, communication or personalized settings. We encourage you to fully analyze each content, passenger's/driver's photo, areas you'll be potentially accompanied, and to contact your driver or passenger prior to the service request to ensure an accurate outcome.

 

To register and become a "user" of the Site, you must be at least 18 years of age to enter into and form a legally binding contract. In addition, you must be in good standing and not an individual that has been previously barred from receiving Quruz Services under the laws and statutes of the United States or other applicable jurisdiction.

 

When you register Quruz may collect information such as your name, email address, birth date, gender, mailing address, occupation, industry and/or personal interests. You can edit your account information at any time. Once you register with Quruz and sign in to our Services, you are no longer anonymous to us.

 

Furthermore, the registering party hereby acknowledges, understands and agrees to:

  • furnish factual, correct, current and complete information with regards to yourself as may be requested by the data registration process.

  • maintain and promptly update your registration and profile information in an effort to maintain accuracy and completeness at all times.

 

If anyone knowingly provides any information of a false, untrue, inaccurate or incomplete nature, Quruz will have sufficient grounds and rights to suspend or terminate the member in violation of this aspect of the Agreement, and as such refuse any and all current or future use of Quruz Services, or any portion thereof. 

It is Quruz priority to ensure the safety and privacy of all its visitors, users and members, especially that of children. Therefore, it is for this reason that the parents of any child under the age of 18 that permit their child or children access to the Quruz website platform Services must create a "family" account, which will certify that the individual creating the "family" account is of 18 years of age and as such, the parent or legal guardian of any child or children registered under the "family" account. As the creator of the "family" account, s/he is thereby granting permission for his/her child or children to access the various Services provided, including, but not limited to, message boards, email, and/or instant messaging. It is the parent's and/or legal guardian's responsibility to determine whether any of the Services and/or content provided are age-appropriate for his/her child.

 

8. PRIVACY POLICY

Every member's registration data and various other personal information are strictly protected by the Quruz Online Privacy Policy. As a member, you herein consent to the collection and use of the information provided, including the transfer of information within the United States and/or other countries for storage, processing or use by Quruz and/or our subsidiaries and affiliates. Please read the Privacy Policy.

9. MEMBER ACCOUNT, USERNAME, PASSWORD PASSWORD AND SECURITY

When you set up an account, you are the sole authorized user of your account. You shall be responsible for maintaining the secrecy and confidentiality of your password and for all activities that transpire on or within your account. It is your responsibility for any act or omission of any user(s) that access your account information that, if undertaken by you, would be deemed a violation of the TOS. It shall be your responsibility to notify Quruz immediately if you notice any unauthorized access or use of your account or password or any other breach of security. Quruz shall not be held liable for any loss and/or damage arising from any failure to comply with this term and/or condition of the TOS.

10. CONDUCT

As a user or member of the Site, you herein acknowledge, understand and agree that all information, text, software, data, photographs, music, video, messages, tags or any other content, whether it is publicly or privately posted and/or transmitted, is the expressed sole responsibility of the individual from whom the content originated. In short, this means that you are solely responsible for any and all content posted, uploaded, emailed, transmitted or otherwise made available by way of the Quruz Services, and as such, we do not guarantee the accuracy, integrity or quality of such content. It is expressly understood that by use of our Services, you may be exposed to content including, but not limited to, any errors or omissions in any content posted, and/or any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted or otherwise made available by Quruz. 

 

Furthermore, you herein agree not to make use of Quruz Services for the purpose of:

  • uploading, posting, emailing, transmitting, or otherwise making available any content that shall be deemed unlawful, harmful, threatening, abusive, harassing, torturous, defamatory, vulgar, obscene, libelous, or invasive of another's privacy or which is hateful, and/or racially, ethnically, or otherwise objectionable;

  • causing harm to minors in any manner whatsoever;

  • impersonating any individual or entity, including, but not limited to, any Quruz officials, forum leaders, guides or hosts or falsely stating or otherwise misrepresenting any affiliation with an individual or entity;

  • forging captions, headings or titles or otherwise offering any content that you personally have no right to pursuant to any law nor having any contractual or fiduciary relationship with;

  • conducting illegal, hazardous, or harmful activities;

  • uploading, posting, emailing, transmitting or otherwise offering any such content that may infringe upon any patent, copyright, trademark, or any other proprietary or intellectual rights of any other party;

  • uploading, posting, emailing, transmitting or otherwise offering any content that you do not personally have any right to offer pursuant to any law or in accordance with any contractual or fiduciary relationship;

  • providing transportation with an unregistered, damaged, illegal, or stolen vehicle;

  • uploading, posting, emailing, transmitting, or otherwise offering any unsolicited or unauthorized advertising, promotional flyers, "junk mail," "spam," or any other form of solicitation, except in any such areas that may have been designated for such purpose;

  • uploading, posting, emailing, transmitting, or otherwise offering any source that may contain a software virus or other computer code, any files and/or programs which have been designed to interfere, destroy and/or limit the operation of any computer software, hardware, or telecommunication equipment;

  • disrupting or hacking the normal flow of communication, or otherwise acting in any manner that would negatively affect other users' ability to participate in any real time interactions;

  • interfering with or disrupting any Quruz Services, servers and/or networks that may be connected or related to our website, including, but not limited to, the use of any device software and/or routine to bypass the robot exclusion headers;

  • intentionally or unintentionally violating any local, state, federal, national or international law, including, but not limited to, rules, guidelines, and/or regulations decreed by the U.S. Securities and Exchange Commission, in addition to any rules of any nation or other securities exchange, that would include without limitation, the Ohio Stock Market, the American Stock Exchange, or the NASDAQ, and any regulations having the force of law;

  • providing informational support or resources, concealing and/or disguising the character, location, and or source to any organization delegated by the United States government as a "foreign terrorist organization" in accordance to Section 219 of the Immigration Nationality Act;

  • "stalking" or with the intent to otherwise harass another individual; and/or collecting or storing of any personal data relating to any other member or user in connection with the prohibited conduct and/or activities which have been set forth in the aforementioned paragraphs.

  • planting a virus or code to interfere or add to the process of Quruz services and/or the user's contents.

 

Quruz herein reserves the right to pre-screen, refuse and/or delete any content currently available through our Services. In addition, we reserve the right to remove and/or delete any such content that would violate the TOS, or which would otherwise be considered offensive to other visitors, users and/or members. 

 

Quruz herein reserves the right to access, preserve and/or disclose member account information and/or content if it is requested to do so by law or in good faith belief that any such action is deemed reasonably necessary for:

  • compliance with any legal process;

  • enforcement of the TOS;

  • responding to any claim that therein contained content is in violation of the rights of any third party;

  • responding to requests for customer service; or

  • protecting the rights, property or the personal safety of Quruz, its visitors, users and members, including the general public.

 

Quruz herein reserves the right to include the use of security components that may permit digital information or material to be protected, and that such use of information and/or material is subject to usage guidelines and regulations established by Quruz or any other content providers supplying content services to Quruz. Furthermore, unauthorized reproduction, publication, distribution, or exhibition of any information or materials supplied by our Services, despite whether done so in whole or in part, is expressly prohibited.

Due to the global nature of the internet, through the use of our network, you hereby agree to comply with all local rules relating to online conduct and that which is considered acceptable Content. Uploading, posting and/or transferring of software, technology and other technical data may be subject to the export and import laws of the United States and possibly other countries. Quruz shall not lay claim to ownership of any content submitted by any visitor, member, or user, nor make such content available for inclusion on our website Services. Therefore, you hereby grant and allow for Quruz the below listed worldwide, royalty-free and non-exclusive licenses, as applicable:

  • The content submitted or made available for inclusion on the publicly accessible areas of Quruz sites, the license provided to permit to use, distribute, reproduce, modify, adapt, publicly perform and/or publicly display said Content on our network Services is for the sole purpose of providing and promoting the specific area to which this content was placed and/or made available for viewing. This license shall be available so long as you are a member of Quruz sites, or platform, and our subsidiaries and affiliates, in association with the use of quruzservices.com, and any existing source authorized by Quruz and shall terminate at such time when you elect to discontinue your membership.

  • Quruz shall not be liable or under any obligation to ensure or maintain confidentiality, expressed or implied, related to any Contributions; 

  • Quruz shall be entitled to make use of and/or disclose any such Contributions in any such manner as they may see fit; 

  • the contributor's Contributions shall automatically become the sole property of Quruz; and

  • Quruz is under no obligation to either compensate or provide any form of reimbursement in any manner or nature.

In addition, you also agree that Quruz has absolutely no responsibility or liability for the removal or failure to maintain storage of any messages and/or other communications or content maintained or transmitted by our Services. You also herein acknowledge that we reserve the right to delete or remove any account that is no longer active for an extended period of time. Furthermore, Quruz shall reserve the right to modify, alter and/or update these general practices and limits at our discretion.

As a member, you agree that Quruz may, without any prior written notice, immediately suspend, terminate, discontinue and/or limit your account, any email associated with your account, and access to any of our Services. The cause for such termination, discontinuance, suspension and/or limitation of access shall include, but is not limited to:

You do hereby acknowledge and agree that Quruz Services and any essential software that may be used in connection with our Services ("Software") shall contain proprietary and confidential material that is protected by applicable intellectual property rights and other laws. Furthermore, you herein acknowledge and agree that any Content which may be contained in any advertisements or information presented by and through our Services or by advertisers is protected by copyrights, trademarks, patents or other proprietary rights and laws. Therefore, except for that which is expressly permitted by applicable law or as authorized by Quruz or such applicable licencor, you agree not to alter, modify, lease, rent, loan, sell, distribute, transmit, broadcast, publicly perform and/or created any plagiarist works which are based on Quruz Services (e.g. Content or Software), in whole or part.

  • QURUZ AND OUR SUBSIDIARIES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENCORS MAKE NO SUCH WARRANTIES THAT 

  1. QURUZ SERVICES OR SOFTWARE WILL MEET YOUR REQUIREMENTS; 

  2. QURUZ SERVICES OR SOFTWARE SHALL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE; 

  3. THAT SUCH RESULTS WHICH MAY BE OBTAINED FROM THE USE OF THE QURUZ SERVICES OR SOFTWARE WILL BE ACCURATE OR RELIABLE; 

  4. QUALITY OF ANY PRODUCTS, SERVICES, ANY INFORMATION OR OTHER MATERIAL WHICH MAY BE PURCHASED OR OBTAINED BY YOU THROUGH OUR SERVICES OR SOFTWARE WILL MEET YOUR EXPECTATIONS; AND 

  5. THAT ANY SUCH ERRORS CONTAINED IN THE SOFTWARE SHALL BE CORRECTED.

YOU EXPLICITLY ACKNOWLEDGE, UNDERSTAND AND AGREE THAT QURUZ AND OUR SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENCORS SHALL NOT BE LIABLE TO YOU FOR ANY HARMFUL, PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES OR OCCURRENCE, INCLUDING, BUT NOT LIMITED TO, DAMAGES WHICH MAY BE RELATED TO THE LOSS OF ANY PROFITS, GOODWILL, USE, DATA AND/OR OTHER INTANGIBLE LOSSES, EVEN THOUGH WE MAY HAVE BEEN ADVISED OF SUCH POSSIBILITY THAT SAID DAMAGES MAY OCCUR, AND RESULT FROM:

  • THE USE OR INABILITY TO USE OUR SERVICE; 

  • THE COST OF PROCURING SUBSTITUTE GOODS AND SERVICES;

In the event you have a dispute, you agree to release Quruz (and its officers, directors, employees, agents, parent subsidiaries, affiliates, co-branders, partners and any other third parties) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, suspected or unsuspected, disclosed and undisclosed, arising out of or in any way connected to such dispute.

26. EXCLUSION AND LIMITATIONS

Every item or information disclosed to Quruz will be monitored by only us and can also be suspended or terminated if we decide it's necessary, in addition, we are not liable to decide that on third party sites, nor are we liable for any harm occurring from third party sites. The links provided throughout the Quruz platform is to advance our services but we are not liable to supervise, be up-to-date, or investigate on the third party sites to validate the modified accuracy, or dependability of their services and/or obligations. We encourage users to thoroughly analyze each content within Quruz platform and the third party's platform, and to manually type their precise information, location, or content posted on Quruz platform and the third party sites. Inaccurate information may result in late; missed; or insufficient service request, harm, environmental or property damage effected upon the user. Locations will be disclosed to the intended user or recipient of the third party sites. Any version of the Quruz App that you've installed into your device through the Apple App Store or Google Play, may have different terms, obligations, and agreements. Apple, Inc "Apple" and Google Play "Google" is not in correlation with this Terms of Service Agreement and have no obligations to Quruz. Apple, Google and their subsidiaries is considered a third party beneficiaries, in regards to that, Apple and Google is liable to use this Agreement against you. The TOS will be useful for Quruz and/or their third party beneficiaries if any mishap occurs. We are not liable for users who disregard the TOS.

28. NOTICE

Quruz may furnish you with notices, including those with regards to any changes to the TOS, including but not limited to email, regular mail, MMS or SMS, text message, postings on our website Services, or other reasonable means currently known or any which may be herein after developed. Any such notices may not be received if you violate any aspects of the TOS by accessing our Services in an unauthorized manner. Your acceptance of this TOS constitutes your agreement that you are deemed to have received any and all notices that would have been delivered had you accessed our Services in an authorized manner.

You herein acknowledge, understand and agree that all of the Quruz trademarks, copyright, trade name, service marks, and other Quruz logos and any  Quruz brand features, and/or product and service names are trademarks and as such, are and shall remain the property of Quruz. You herein agree not to display and/or use in any manner the Quruz logo or marks without obtaining Quruz prior written consent.

30. COPYRIGHT OR INTELLECTUAL PROPERTY INFRINGEMENT CLAIMS NOTICE & PROCEDURES

Quruz will always respect the intellectual property of others, and we ask that all of our users do the same. With regards to appropriate circumstances and at its sole discretion, Quruz may disable and/or terminate the accounts of any user who violates our TOS and/or infringes the rights of others. If you feel that your work has been duplicated in such a way that would constitute copyright infringement, or if you believe your intellectual property rights have been otherwise violated, you should provide to us the following information:

  • The electronic or the physical signature of the individual that is authorized on behalf of the owner of the copyright or other intellectual property interest;

  • A description of the copyrighted work or other intellectual property that you believe has been infringed upon;

  • A description of the location of the site which you allege has been infringing upon your work;

  • Your physical address, telephone number, and email address;

  • A statement, in which you state that the alleged and disputed use of your work is not authorized by the copyright owner, its agents or the law;

  • And finally, a statement, made under penalty of perjury, that the aforementioned information in your notice is truthful and accurate, and that you are the copyright or intellectual property owner, representative or agent authorized to act on the copyright or intellectual property owner's behalf.

31. CLOSED CAPTIONING

BE IT KNOWN, that Quruz complies with all applicable Federal Communications Commission rules and regulations regarding the closed captioning of video content.

32. ENTIRE AGREEMENT 

This TOS constitutes the entire agreement between you and Quruz and shall govern the use of our Services, superseding any prior version of this TOS between you and us with respect to Quruz Services. You may also be subject to additional terms of service that may apply when you use or purchase certain Quruz Services, affiliate Services, third-party content or third-party software.

33. CHOICE OF LAW AND FORUM

It is at the mutual agreement of both you and Quruz with regard to the TOS that the relationship between the parties shall be governed by the laws of the state of Ohio without regard to its conflict of law provisions and that any and all claims, causes of action and/or disputes, arising out of or relating to the TOS, or the relationship between you and Quruz, shall be filed within the courts having jurisdiction within Summit County, Ohio or the U.S. District Court located in said state. You and Quruz agree to submit to the jurisdiction of the courts as previously mentioned and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.

34. WAIVER AND VENERABILITY OF TERMS

At any time, should Quruz fail to exercise or enforce any right or provision of the TOS, such failure shall not constitute a waiver of such right or provision. If any provision of this TOS is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of the TOS remain in full force and effect.

35. NO RIGHT OF SURVIVORSHIP & TRANSFERS

You acknowledge, understand and agree that your account is non-transferable and any rights to your ID and/or contents within your account shall terminate upon your death. Upon receipt of a copy of a death certificate, your account may be terminated, and all contents therein permanently deleted.

36. STATUTE OF LIMITATIONS

You acknowledge, understand and agree that regardless of any statute or law to the contrary, any claim or action arising out of or related to the use of our Services or the TOS must be filed within 1 year after said claim or cause of action arose or shall be forever barred.
